    M.G.L. ch. 90C Sec 2. This statute mandates that a police officer hand the driver a citation at the scene, unless he is unable to do so. The cases have defined those exceptions very narrowly. If you were not handed a citation, the correct procedure is to file a Pre-Trial Motion to Dismiss. The added advantage is that the hearing is a procedural one and the Judge doesn't have to hear about the offense that brought your client to court. I did this recently and was successful. Has anyone had a similar experience.?
